IF YOU GET INTO AN ACCIDENT:
1. If you are seriously hurt, request an
ambulance -- trying to walk with a serious injury,
or waiting too long to get treatment, may worsen your
injuries.
2. If you are hurt, but are certain
that you do not need an ambulance, seek medical
treatment as soon as you possibly can.
3. Exchange information with the other
driver or drivers. Ask to see his or her driver's
license and insurance cards, and carefully record all of
the information contained on these cards -- you will
need this information. Some important information you
should get includes the other driver's name, address and
telephone number; his driver's license and social
security numbers; the make, model, year and license
plate number of his car; his insurance company's name,
address and phone number, along with his policy number;
and, the names, addresses and telephone numbers of any
individuals who may have witnessed the accident -- this
includes any passengers who may have been riding in
either vehicle.
4. Report the accident to the police. If
the accident was serious, try to leave the accident site
alone until police arrive -- do not move your vehicle
unless it presents a safety problem for other motorists.
Get a copy of the police report, and be sure to write
down the other driver's ticket number and court date and
location if he is cited by police. If the accident is
only a "fender-bender", move to the side of
the road, exchange information with the other driver,
and go directly to the nearest police station to file an
accident report.
5. Notify your insurance company of the
accident -- they will need all of the information above
when you call in, so make sure you have everything at
your fingertips.
6. Do not admit fault -- remember,
you are not a lawyer! Truthfully report the events
leading to the accident, but never say, "it
was my fault." Simply believing that you are at
fault does not mean that you are at fault. A good
example of this is the situation where you have entered
an intersection without any traffic controls, and
afterward a driver enters the intersection from your
right and strikes your vehicle. While most people think
the driver on the right has the right of way, this only
applies if you are entering the intersection at
approximately the same time. If you have already entered
the intersection, you have the right of way!
7. Do not sign anything from your insurance
company or the other driver's insurance company -- you
may be signing a release without even knowing it!
8. The other driver's insurance company may
tell you that you do not need a lawyer -- don't
believe them! Remember, their job is to pay you the least
possible amount of money they can get away with!
9. Protect your rights by contacting
an attorney experienced in the area of personal injury
as soon as you can!
